"STIHL GARDEN ASSAULT" PROMOTION

TERMS AND CONDITIONS

1STANDARD TERMS

1.1By entering the "STIHL GARDEN ASSAULT" Promotion, you are agreeing to the following terms and conditions.

 

2WHO CAN ENTER

2.1Subject to clause 2.2 Entry is only open to Australian residents aged 18 years or over.

2.2Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

 

3HOW TO ENTER

3.1The Competition commences on Monday 2 March 2009 @ 1701 AEDT and concludes on Sunday 24 May 2009 @ 1700 AEST ('the competition period') however, the eligible entry period for each weekly prize will commence and conclude on the following dates and times:

3.2In order to enter individuals must either:

ASend a text message/SMS to 19 700 612 including a keyword and their name

BFill in their name and mobile phone number into the forms on a "WAP" mobile website accessed from their mobile phone

CGo to www.gardenassault.com.au and enter via the form on that website.

3.3All entry lines will remain open from Monday 2 March 2009 @ 1701 AEDT to Monday 25 May 2009 @ 1700 AEST.

3.4The maximum entry costs is $0.55 (including GST). Note that SMS entries are charged at premium rate.

3.5Entrants (including the winners) may enter the competition as many times as they like. The time of entry will in each case be the time the SMS message are received by the m.Net Corporation database.

3.6Entrants can play the Garden Assault game multiple times, but will only receive one (1) entry into a prize draw for the duration of the competition period.

3.7Incomplete, indecipherable, or illegible entries will be deemed invalid.

3.8SMS entries via the internet or computer generation are invalid and will not be accepted.

 

4PRIZES

4.1There will be one (1) winner weekly (12 in total). Winners will receive the prize package set out below

4.2TOTAL MAXIMUM PRIZE POOL VALUE: $7,068.00. Prize value is correct at the date of printing (28/1/2009). The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is won.

4.3If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

4.4Winners should seek independent financial advice about any tax implications that may arise from the prize winnings.

4.5Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

4.6It is a condition of accepting the prize that the winner must comply with all conditions of use of the prize and the prize supplier's requirements.

4.7Entries will not roll over into subsequent draws.

4.8The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4.9If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

5HOW TO WIN

5.1One (1) weekly winner (12 x in Total) - will be drawn from the national pool of weekly entrants received. Each entrant who has entered the competition by the closing time for that week and registered all details in accordance with clause 3 whose SMS message has passed through the Telco carriers between the daily competition dates and times as stated in clause 3.1 ("Qualifying Entrant") will be entered into the relevant weekly prize draw following the close of entries for that draw. The weekly draw will be conducted on Tuesday 10 March2009, Tuesday 17 March 2009, Tuesday 24 March 2009, Tuesday 31 March 2009, Tuesday 7 April 2009, Tuesday 15 April 2009, Tuesday 21 April 2009, Tuesday 28 April 2009, Tuesday 5 May 2009, Tuesday 12 May 2009, Tuesday 19 May 2009 and Tuesday 26 May 2006 @ 1600 AEDT/AEST. All draws will take place at at Stihl Pty Ltd, 5 Kingston Park Court, Knoxfield VIC 3180

5.2During the competition period. Winners will be notified by phone call within 2 days of the draw and a letter advising winners of their prize will also be mailed out. All winners will be published in the Public Notices section of The Australian newspaper on Monday 6 April 2009 for Draws 1-4, Monday 4 May 2009 for draws 5 to 8 and Monday 1 June 2009 for draws 9-12.

5.3The promoter's decision is final and the promoter will not enter into correspondence regarding the result.

5.4It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

5.5Subject to State government legislation, an unclaimed prize draw from all non-winning entries will take place at Stihl Pty Ltd, 5 Kingston Park Court, Knoxfield VIC 3180 on Monday 7 September 2009 at 116.00 AEST and winners will be published in the Public Notices section of The Australian newspaper on Monday 14 September 2009.

 

6NO LIABILITY

6.1Stihl Pty Ltd & affiliates, m.Net Corporation Ltd, and their associated agencies and companies associated with this promotion, will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail

6.2Stihl Pty Ltd & affiliates, m.Net Corporation Ltd, and their associated employees, agencies and companies associated with this promotion will not be liable for any misadventure, accident, injury, loss or claim, damages, costs and expenses suffered, sustained or incurred (including but not limited to indirect or consequential) as a result of, or arising out of, or in any way connected with this Promotion and/or its prizes that may occur:

(a)during the draw;

(b)in the participation in any prize;

(c)as a consequence of late, lost or misdirected mail;

(d)relating to the competition or the publication of any material, including any statements made by any, staff member, other, entrants or any other person;

6.3in relation to failure of an SMS entry message to be received by the promoter on account of technical problems or traffic congestion;arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion; or due to circumstances outside the promoter's reasonable control.

6.4Subject to State Regulation, in the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.

6.5STIHL Pty Ltd & affiliates, m.Net Corporation Ltd, and their associated agencies and companies associated with this promotion assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available.

6.6Subject to State Regulation, if for any reason this competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition.

6.7As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form

7.2Entry details remain the property of the promoter. m.Net Corporation Ltd on behalf of Stihl Pty Ltd (ABN 76 004 881 145) and its related entities ("Stihl"), is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying the winners). The entrant's personal information may be disclosed to m.Net Corporation Ltd for this purpose. The entrant may request access to his or her personal information by writing to Privacy Officer, m.Net Corporation Ltd, Level 2, 8 Leigh Street, Adelaide SA 5000 or emailing privacy@mnetcorporation.com.
